its subsidiaries, associates and affiliated companies (collectively referred
to as KFintech) has a requirement to collect and process Personal Data or
Sensitive Personal Data or Information (SPDI) in accordance with the
Information Technology (Reasonable Security practices and procedures and
Sensitive Data or Information) Rules 2011(Rules) and the Digital Personal
Data Protection Act, 2023 (DPDPA.
Kfintech is committed to protecting your privacy and ensuring the
confidentiality of the information entrusted to us. This Privacy Notice
outlines how we collect, process, and protect your Personal Data, and inform
you of the rights you can exercise regarding your data and how to contact us
for any concerns.
This notice outlines how we collect, use, and protect personal data captured
during video conferences on the eVoting website and the eMeeting Website, in
compliance with applicable Data Privacy Regulations. This Privacy Notice
applies only to KFinTech’s collection, use, disclosure, and protection of
your data. It does not apply to other party websites of depositories, to the
time of e-Voting.
Information Collection:
We collect your personal details, including First name, Last Name, DP ID,
email ID, contact number, folio details including PAN, password, audio and
video (as part of Meeting recordings), and digital identifiers (IP
addresses, cookies, and biometric data) for virtual attendance verification.
This data may further be shared with your Company for whom Kfintech is
managing the shareholding as an RTA.
In case of Appointed nominee of Institutional Shareholders, the Appointment
letter/Board resolution as a PDF document will be uploaded containing the
nominee details.
Purpose of Collection:
The personal data is processed solely to facilitate the AGM participation,
enable secure voting, and fulfil statutory recording and legal and
regulatory compliance obligations under applicable laws and regulations.
Personal Information is collected and processed for the following purposes:
- To allow access to applications to participate in AGM
- For validation of attendees
- Generating attendance records
- For managing administrative activities during your participation in
AGM, including e-voting through depository
- To maintain records and comply with necessary disclosure
requirements to shareholders, government authorities, as per
applicable laws
- For statistical and research purposes
Your data is accessible and disclosed to authorized users at Kfintech,
designated authorized individuals from your Company where you have holdings,
external auditors and regulatory authorities. Kfintech has implemented
reasonable and appropriate safeguards to prevent unauthorized access,
unlawful processing, unauthorized or accidental loss or destruction of
Personal Information.
Legal Basis:
The processing is based on your consent to enable you to participate in the
AGM video conference and for legitimate interests to safeguard your data
against unauthorized access and misuse.
Data Protection and Retention:
Personal data is stored securely, accessed only by authorized personnel, and
retained only for the duration necessary to comply with legal and
operational requirements before deleting securely.
Your Rights:
Shareholders have the right to access, correct, amend or request the erasure
of their personal data, subject to applicable laws and regulations. Such
requests will be fulfilled subject to conflicting and other applicable laws.
